Terms of Service — PRO360 Technology

These Terms of Service ("Terms") are an agreement between you (or the organisation you represent) and PRO360 Technology ("PRO360", "we", "us") governing your use of our software, digital products and website (together, the "Service"). By subscribing to or using the Service, you agree to these Terms. If you do not agree, do not use the Service.

1. Eligibility & accounts

You must be at least 18 and able to enter a binding contract, and — where you act for an organisation — authorised to do so on its behalf.
You are responsible for keeping your login credentials secure and for all activity under your account.
You must give accurate account information and keep it up to date. Tell us promptly of any unauthorised use.

2. The Service & subscriptions

We grant you a non-exclusive, non-transferable right to use the Service during your subscription, for your internal business purposes.
Subscriptions, plans and prices are as described on our pricing section or in your order. Prices are in Malaysian Ringgit (RM) and exclude SST unless stated.
Fees are billed in advance for each billing period and renew automatically until cancelled.
Cancellations and refunds are governed by our Refund, Cancellation & Returns Policy.

3. Acceptable use

You agree not to:

Use the Service unlawfully, or to store or transmit unlawful, infringing or harmful content.
Attempt to gain unauthorised access to the Service, other accounts, or our systems.
Reverse-engineer, copy, resell or white-label the Service except as expressly permitted in writing.
Interfere with or disrupt the integrity or performance of the Service, or overload it through automated means.

4. Your data & ownership

You own your data. Data you enter into the Service remains yours. You grant us the limited rights needed to host and process it to provide the Service.
We process personal data as described in our Privacy Policy. Where we handle data about your people, we act as your data processor.
You are responsible for the accuracy and lawfulness of the data you put in, and for having the right to process it.
On termination you may export your data within a reasonable period, after which we may delete it.

5. Intellectual property

The Service, including all software, design, and content we provide, is owned by PRO360 and protected by law. These Terms grant you a right to use the Service, not any ownership of it. Any feedback you give us may be used to improve the Service without obligation to you.

6. Availability & support

We work to keep the Service available and secure, but do not guarantee it will be uninterrupted or error-free. We may perform maintenance, update features, or suspend access where necessary to protect the Service or comply with law. Support is provided through the channels stated for your plan. Any service-credit or downtime remedy is as set out in our Refund, Cancellation & Returns Policy.

7. Third-party services

The Service may integrate with third-party providers (such as hosting, payment gateways, messaging and accounting tools). Your use of those services is subject to their own terms, and we are not responsible for them.

8. Warranties & disclaimer

The Service is provided "as is" and "as available". To the fullest extent permitted by law, we disclaim all implied warranties. Our systems help you manage payroll, statutory and financial matters, but you remain responsible for verifying outputs and meeting your own legal, tax and regulatory obligations.

9. Limitation of liability

To the fullest extent permitted by law, PRO360 is not liable for indirect, incidental or consequential loss, or for loss of profit, data or goodwill. Our total liability arising out of or relating to the Service is limited to the fees you paid us for the Service in the twelve months before the event giving rise to the claim. Nothing in these Terms excludes liability that cannot be excluded under Malaysian law.

10. Confidentiality

Each party will protect the other's confidential information and use it only to perform under these Terms. This does not apply to information that is public, independently developed, or required to be disclosed by law.

11. Term & termination

These Terms apply for as long as you use the Service.
You may stop using the Service and cancel under the Refund, Cancellation & Returns Policy.
We may suspend or terminate your access if you materially breach these Terms, fail to pay, or use the Service unlawfully — with notice where practicable.

12. Changes to these Terms

We may update these Terms from time to time. The current version is always the one published on this page. If a change is material, we will take reasonable steps to notify you. Continued use after a change means you accept the updated Terms.

13. Governing law

These Terms are governed by the laws of Malaysia, and the courts of Malaysia have jurisdiction over any dispute, without affecting any mandatory consumer rights you may have.
